The Office of Special Masters (OSM) resolves cases alleging that vaccines caused an injury pursuant to the National Childhood Vaccine Injury Act of 1986 (“Vaccine Act”). The Vaccine Act establishes the Vaccine Program as a no-fault compensation scheme whereby persons allegedly suffering injury or death as a result of the administration of certain vaccines may petition for monetary damages. Congress intended that the Vaccine Program provide individuals a swift, flexible, and less adversarial alternative to the often costly and lengthy civil arena of traditional tort litigation.

Special Masters, acting as the trial judges on vaccine cases, frequently preside over hearings, which are conducted under relaxed evidentiary standards. Subject to an appeal, Special Masters make final decisions determining whether the vaccine caused an injury (entitlement), establishing the amount of damages, and awarding reasonable attorneys’ fees.
